Dismissal of divorce and alimony on grounds of adultry

26-Jun-2024 (In Divorce Law)
My partner is married and has been in an abusive marriage for the past 14 years. She left her husband and lived separately for 4 years after being tortured by her in laws. Recently husband cut her with knife and strangled her. Husband was arrested and granted P.S bail. She left home and is living in my area separately but husband has not contacted since. She and I have spent a few nights in hotels recently. Can this affect her divorce and can she be denied alimony that she is claiming?

Well, Her Physical Relations with you cannot impact her Divorce, however, it will impact her Interim Maintenance, Final Maintenance or/and Alimony Order passed by the Court. In short, yes, she can be denied Alimony, if it gets proven before Court, that, she indulged physically with you during Divorce Proceedings
