Under Hindu law for divorce by mutual consent, is wife required to disclose all her personal assets like Jewelry, savings and money inherited from parents to the husband to get the divorce? Also, will she get any maintenance if her assets and income is more than husband's but is still not sufficient to meet all expenses for herself and the child who will stay with her.

Hello divorce by mutual in Hindu marriage act is purely on the terms and conditions mutually decided by the husband and wife to dissolve the marriage. Generally mutually it is decided about permanent alimony, maintenance of wife and children, custody of children and their welfare. If wifes is earning sufficiently to maintain herself she cannot claim maintenance but children maintenance and welfare shall either be borne by one parent or can be shared jointly. it shall be decided mutually with whom children will stay.

see if your wife and you are taking divorce by mutual consent then that means that you both are already agreed upon all the facts . then there remains no question of any jewellery or any maintenance or anything since while recording the statement in section 13b it is specifically mentioned there that the wife will not be having any claim in any property or any maintenance or anything . however there are certain authorities that allows a woman even though she is divorced to get maintenance from her husband .
