demat account claim in divorce

i put my salaried money in my wifes name demat account during our 5 years married life . 100% money is having my source of income .can my wife claim demat holding in divorce petition since demat is in her name . she was housewife during our married life

We need more facts on this …that the money which was coming from your salary to demat account of your wife …if that amount still in her account then you can simply go for recovery and this is the way to recover that amount ..thank you n b in touch

Hi It will completely depend on the terms of your separation. In case you go for a mutual divorce, you can decide the division before hand. In case a 125 case is filed, the amount will be decided by the court. Feel free to get in touch in case of further discussions. Regards Adv. Abhinav Sharma
