DV case disposed off in favour of me after 3 yrs on the ground of limitation period. Can I file defamation case against wife?

Yes, you can always file defamation case. where dv petition has been disposed off you can seek compensation from your wife by filing civil suit of defamation. however if certain defamatory remarks. were made by her in the dv petition criminal case of defamation can also be filed where maximum imprisonment is for 2 years.

Dear Client You can proceed with the defamation case under the Sec 500 IPC, and also ask for damage recovery in Sec 9 of CPC can also be filed. You can also proceed with Sec 340 CrPc for the Perjury case against false evidence given by the wife during the case. Hope this helped you.

Yes you can always file a defamation case against her if your reputation is hurt in the society. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.
