Custody of 5 years son to father

I am 35yrs old and married my wife in 2019. Since then she started harrassing me and my parents by using abusive words and physically abusing me. We have a son(5yrs), she doesn't care him like mother she always hits my son in front of me to provoke. She literally accuse me of hitting her, my son is very afraid of staying with her alone, he always asks me to take outside where ever I go. Because she hits him if he doesn't complete food in 10min and many other things. Please help
I am so sorry to hear that you are facing a very difficult and stressful situation . I strongly advise you to immediately file a written complaint to your nearest police station to mention abuse to you , and false allegations on you, including child cruelty . Domestic violence and child abuse are serious issues that need immediate attention . It's not okay for her to accuse you to hitting her when you have not . File a police complaint under section 75 of Juvenile justice act 2015 punishment for cruelty to child .
Section 23 of POCSO act for physical abuse . Immediately consult a lawyer.

hi for getting custody of your son you could file custody petition in court on the ground that she is not looking after the child properly and that you need to look after the child for his well being and take care after him
