Custody case is ugly , child is frequently sick y sick.

My husband beat mercilessly in front of child. I left marital home with my child came to parents home. Husband abducted kid.i have been in court since 4 months no order is passed. No contact with kid. I m traumatized. And hopeless. Child is 6 year and 4 months old. My husband discarded my clothes books n things.

Domestic violence and child abduction are serious offences. You should urgently seek interim custody and visitation under Guardians and Wards Act, file DV Act reliefs, police complaint, and press for urgent interim orders for child’s welfare.

What you have described is serious domestic violence. Taking the child away without any court order and keeping you away from your child for months is illegal. Since the child is very young, the law says the child should not be separated from the mother. You have a strong right to ask the court for immediate access or temporary custody of your child, along with protection and return of your belongings. In urgent cases like this, even the High Court can step in to protect the child.
