you are free to file a divorce against your wife and in your section 9 if court sat properly then it will decide within 3 months you do not have any need to wait to file your divorce case against your wife you can proceed it you are free to do it

rcr section 9 is to be filed after 1 year 5 notice js saka hain you cam complaint to the police and you haven't been heard this is against the principal of natural justice. divorce ke like kuch ground hone chahiye valil se discussion Karo Esa kyun ho raha hai

agar opposite party appear nhi ho rahi ha to apko apna sec 9 suit exparte karana padega. uske bad 3 date me apka suit decree ho jayega. or agar notice received nahi ho pa raha ha to aap publication kara dijiye uske bad court exparte proceedings start kar degi.
