If the man is hindu, then in that case second marriage is not allowed as per Hindu Marriage Act until he is not divorced from his first wedlock as per the law. Once he is divorced he can proceed for second marriage, before divorce the second marriage will be consider as illegal and the man can be held for bigamy which is a penal offence under the IPC. Thanks
