Counselling got failed. My wife filed maintenance.

My wife left 2 yrs ago. She filed sec 9. I filed Sec 13 1ia. In counselling mediation failed and he prepared report and points. Now my wife is going to file maintenance case, parents property share. Earlier she was working women but not now. How to win Section 125 CrPC?

entitlement of a wife to maintenance from her husband is governed by various laws and circumstances. If the wife is found to be involved in an extramarital affair or adultery, she may be barred from claiming maintenance. If the wife has sufficient independent income or financial resources to support herself, the court may not grant maintenance. If the wife unreasonably refuses to live with her husband without any valid reason, she may be denied maintenance.

Dear Friend, Sec 125 has these defences that if wife is living in adultery, or if, without any sufficient reason, she refuses to live with her husband, or if they are living separately by mutual consent, she is not entitled to maintenance if you prove anything of these in

You should engage a lawyer having expertise in matrimonial laws and seek a detailed consultation. In case she is qualified and has the earning capacity the court will not grant maintenance or will give nominal sum. However the case needs to be presented effectively.
