Contested case to be finalised without hearing my side as pe new law?

Hi, after my delivery my husband did not want to live with me for some misunderstandings. He filed divorce case in 2021 under cruelty and I filed maintenance and RCR. maintenance case is stil not actioned upon and now my lawyer is telling as per new rule by HC ( as on June 2023) , the court will grant divorce in favour of my husband even if the alimony is not finalised. Is this true? Will court grant divorce without hearing my side just because my husband do not want live with me ? (Also we go

There is no such thing. Both parties must be heard to decide on a petition. If one party does not appear before the court then then only the court will pass orders in favour of the attending party. Fixing alimony depends on the facts and circumstances of the case.
