Completed mutually divorce, what to do pending 125 main case,

498A withdrew, 125 intrem order is disposed, special marrige act sec 28 mutual divorce completed, but 125 main case pending, is this case harmful to me in future? What is the procedure to disposed this case?

if mutual divorce decreed then there cannot be any case under Section 125 crpc pending since the terms of mutual divorce would guide the parties and no further remedies of any of the parties particularly with respect to maintenance is maintainable. hence to answer your queries it's not harmful to you at all. and just make an application with the copy of the decree before the magisterial court to get the case dismissed. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi), Advocate, High Court, Calcutta.
