Complaint in Police and CAW Cell different
19-Sep-2024 (In Divorce Law)
My wife has filed a complaint against me and my family for harassment but in CAW cell counseling, my wife did not say anything about harassment to her. I will do everything necessary and cooperate with the Police, but can we get the FIR quashed based on the CAW cell discussion, as she did not mention anything there for any harassment?
Well definitely, you can get the FIR quashed by filing a Petition in the concerned High Court. In CRPC, there was a provision of Sec 482 of the CRPC, 1973, as per which, accused persons used to file Quashing Petitions. Now, as per the Bhartiya Nagarik Suraksha Sanhita, 2023, mere Section has been changed under which you can file for Quashing
If you have sufficient evidence which can convey the court that the FIR registered against you and your family is false and baseless, you should definitely approach the High Court for getting the FIR quashed. You can share all the relevant papers and documents for ascertaining whether to go for quashing or no.
