Claiming maintenance in a contested divorce
02-Feb-2023 (In Divorce Law)
Generally the husband has to pay money as a settlement at the time of divorce. In case the husband does not want to give divorce but the wife wants it, will the husband still has to pay?
No, if wife doesn't want to live with her husband then husband will not liable to pay maintenance to her.
In case* your wife is in any service, business, profession or earning money by above-mentioned ways
and you are suffering economically to maintain yourself then you can also file maintenance against your wife U/S 125 cr.p.c.

Hello sir In our country generally the husband has to pay alimony to his wife. But there are some cases when the husband is found to be harassed and the court passes the judgement that the wife would compensate his losses. There are few cases where the law has been very stringent and has compelled the husband to pay the alimony when he does not have to any income source while the wife function s at very lucrative job. and secondly when the husband is unable to earn or is disabled. The court may ask the wife to pay the alimony.
Hi,
First u tell ur all detail, coz in Hindu Law and Muslim Law there r differences.
Note:
1. A wife, whether married or getting divorced, who is dependent on her husband is entitled to a maintenance amount.
2. If the wife is not employed or does not earn enough to support self, she is entitled to alimony. This is true even when she earns but her income is not enough to support the same living standard as that of her husband.

No, this time it totally depends on the husband if he wants to pay or not.
But the wife can file a series of 4-5 cases like dowry/domestic violence/wife's maintenance and some more, which will compelling him to pay money.
