16-Jun-2023 (In Divorce Law)
I am hindu and staying with my minor son 3.5years age for more than a year separately. My husband has filed mat suit u/s 22 and also taken visitation order. Now i have been advised to file maintenance. 5years of my marriage i was paying for myself and my son 's childcare fooding and lodging. I have account statements showing money transfers every month. Last 1year he has not sent a single penny. I and my husband both r working in a bank. Can i claim maintenance for the past and future both? What all can I claim? Please advise

yes you can claim it all but proper homework is what is mandatory to obtain the funds in accordance with laws many would want to delay proceedings for their own benefit so it is better to understand the entire process before taking any sort of leap so that you dont repent taking the leap

future certainly. as far as past is concerned I'm afraid since you choose not to exercise your right of maintenance you cannot have any claim over such period. your employment will not preclude you from claiming maintenance especially for your son. but be sure your employment will surely be a fator in deciding the quantum of maintenance.
