Child visitation rights going extremely slow

15-Mar-2026 (In Divorce Law)
Is there anyway to expedite child visitation rights? My wife was found in adultry and has taken my child away. She doesn’t let me meet my 3 year old son now. I hv filed for divorce, custody and visitation in family court but the process is extremely slow.

You can file an application for interim visitation rights in the Family Court so that you may meet your child during the pendency of the case. You may also request the court for urgent hearing/early listing if you are being denied access to the child. The court decides visitation primarily on the welfare and best interest of the child.

Hello, I understand your concern. To expedite your rights, we will file for Interim Visitation under Section 12 of the Guardians and Wards Act, requesting an urgent hearing as the child is only 3 years old. Under the new legal framework of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, courts are now more focused on the 'Best Interest of the Child' to ensure emotional well-being is not compromised by slow litigation. To discuss the application of these new sections and build a winning strategy for your specific case, I recommend a Paid Consultation. This will allow us to move the court immediately for your visitation rights. Advocate Sudesh Kumar LLB and LLM
