From the facts stated, you have valid and strong legal grounds to seek divorce on the grounds of cruelty and desertion. Physical assault, continuous ill-treatment, and long separation are recognised by courts as sufficient reasons to dissolve the marriage. You are also legally entitled to claim maintenance for your minor daughter as well as child custody and educational expenses. The husband has a legal obligation to provide financial support irrespective of whether you are earning or not. The court will determine the amount based on his income, standard of living, and the child’s needs. You may simultaneously initiate proceedings for divorce, child maintenance under relevant provisions, and also seek protection and residence orders if required. Early legal action and proper documentation of cruelty, medical records, and evidence of separation will strengthen your case and help in securing timely relief.
