Child legal custody with father - what needs to be done

27-Sep-2023 (In Divorce Law)
My girl child is 40 days old. My husband is behaving strangely from the past few days. He does not talk to me properly and stays aloof. It seems he doesn't want to live with me either. I am unable to understand what he wants. I want him to take custody of the child for better financial and social security of the child. I am not earning.

It's advisable for you to first of all sit and talk regarding the strange behaviour. It can be presumed that he is disturbed with anything which can be solved by merely talking to him. And if there is no positive response then you can always serve him a legal notice regarding your grievances and ask whether he wishes to continue the marriage.

You can file maintenance for your child as well as for you under section 24 of Hindu Marriage act and 125 of CrPC against your husband. However your child is too small and your husband cannot claim the custody.

talk it out with your husband. there might be something troubling him. custody case of child is filed to get custody and not give it. 40 days old child needs her mother. you can claim maintenance of both child and yourself from husband.
