Greetings for the day! Yes, you will have to file for a guardianship under the guardianship and ward act, 1890. As per Section 6 of the Hindu minority and guardianship act, 1956, the father is the natural guardian and after him, the mother. For any further assisted feel free to connect.

A petition for child custody or declaration regarding appointment of natural or legal guardian of minor starts child with the filing of the petition by the spouse seeking child custody. Notably, in child custody cases non-custodial parent seeks the custody/guardianship of the minor child. Such petition usually takes longer time and thus application for Interim or Temporary custody as well as Visitation Rights can also filed by the Non-custodial parent.

If you a are Hindu and the solemnisation of the marriage was according to Hindu laws, then you will have to file a petition under Sec 26 of the Hindu marriage act, 1955 for the child custody. The court grants the custody of the child after scrutinising various parameters like welfare of child, wish-fullness of the child etc. For any further legal assistance please feel free to contact.
