child custody from mother to father

My kid wants to stay with me (father), she is 10 years old. She hates her mother totally. Her mother is busy in her own world. How to get the custody immediately from mother. We are not divorced yet.

Father being a natural guardian can seek permanent custody of the child by filing a case under Guardianship Wards Act. Wellbeing of the child is of prime importance while granting custody of the child. Being Divorce is not an important criteria for child custody.
