Child Custody allowed to Father from Father in Law/Mother in Law

In my case I have contested Child Custody and Allowed by Family Court. 1 Month time has been passed as per court order but they did not hand over child to me. What should I have to do File a Habeas Corpus in High Court, Contempt of Court or Execution of Order. Note - Mother of the child is no more, 304 B was files against me but acquitted from the charges.

helo I advocate Ajay godara form hisar mana app kay case ki study ki ha app ka custody matter ha app court order kay kilaf high court may case dala ha app order ki copy send kijiye taki ap ki puri help ki jaya

You have to file a contempt petition Because the opposite party didn’t complied with the court order. And after notice served and the other party appeared before the court then you can tell the court to issue conditional warrants if they still do not comply with the court order.

We would suggest you to first exhaust all your remedies in the lower court and only then proceed to high court. File an execution first. If that also doesn’t help your case, then go to high court with petition. It is always wise this way.
