Chargesheet filed but summons not issued
17-Feb-2026 (In Divorce Law)
Hello we have lodged a complaint against my husband on nov-21-2025 we got a msg by saying ur final report chargesheet sheet has been filed
But till now we have not received any summons
What are the reason for this
In practice, in many courts in Hyderabad, there can be significant delay between filing of the charge sheet and issuance of summons. Due to heavy pendency and administrative processing, it may sometimes take 1.5 to 2 years for the court to take cognizance and issue summons. This delay is procedural and does not mean the case has been closed or dismissed. You may periodically check the case status in the concerned court to know the present stage.
It is common that even after filing of the charge sheet, summons may take some time to be issued. After submission of the final report, the Magistrate has to take cognizance of the offence, scrutinize the case records and then issue the process to the accused. This administrative and judicial procedure may cause delay.
You may verify the present stage of the case in the concerned court through your advocate or by checking the court records. If cognizance has already been taken and summons are still not issued, an application may be filed seeking early issuance of summons and expeditious trial.
There is no need to worry. Such delay does not affect the strength of your case. It is advisable to regularly follow up the matter so that the proceedings move forward without unnecessary delay.
