Change of jurisdiction for a divorce case by a wife

i got married according to Bindu marriage act in 2014..my husband was absconding 1 year after marriage suddenly after 2 years he has come back with a divorce case filing in noida..we both are born and brought up in Assam.. I work in a small company in Bangalore.. my income is less and I have to take care of my parents..so can I change my jurisdiction to bangalore

You will have to apply for a transfer from the Allahabad High Court which has jurisdiction over the Family Court in Noida for a transfer of the Case to Bangalore. My advice is to instead appear in the Noida Court and try to settle the matter with the assistance of the Mediation Center and conclude the case soon. Through mediation, sometimes the case can be closed within a week. If you want to contest it, you will either have to appear in Noida Court every time or seek transfer from Allahabad High Court both of which can be time-consuming and expensive.

Here madam,

When the case of two different state, then the supreme court having the power to exercise the power.

"Section 25 of the Code of Civil Procedure enables the Supreme Court to transfer any Case, appeal or other proceedings from High Court or other civil court in one State to a High Court or other civil court in any other State. This power may be exercised by the Supreme Court if it is satisfied that an order under this Section is expedient for the ends of justice. Hence wide powers are given to the Supreme Court to order a transfer if it feels that the ends of justice so require.


So you can file a leave petition before the supreme court and you can sought for transfer of the case. Here, you should mention the genuine reason for what purpose you are seeking for transfer.
