section 497 of IPC dealing with adultry has already been repealed after judgement of supreme court. so no penal charges. however it still remains a ground for divorce. so it is not a criminal act anymore.

legally it is not correct to have extramarital but if you have one there can be no conviction as per supreme court directives and divorce can happen and the man has to shed out funds to the woman if the other wife can prove the adultery which will take years
