Can we file discharge application to remove name from false 498A Case

Hi My sister in law filed wrong 498 case where she has given 8 family members name in it but we appealed in high court for quash in which 3 family members name has been removed but still 5 persons name is remaining now the case comes in trial court so kindly advice whether we can file discharge application to remove my siblings name from case by showing proper evidence in court and how much time it takes to remove the name from 498 case
