Can remarriage be declared null and void
06-Jan-2025 (In Divorce Law)
Husband won divorce case in high court on the ground of cruelty. He got remarried with some another woman after 90 days of obtaining divorce decree. First X wife filled SLP in Supreme Court after 6 months of divorce. Can Supreme Court reverse the divorce decree or declare the remarriage null and void which was happened after waiting the appeal limitation period
Dear Sir,
Since it was effected and second marriage has happened so first wife is only entitled for alimony to the larger extent. Once divorce decree was granted and no stay was granted by the Supreme Court so your husband legally married for the second time which cannot be cancelled. You may seek appropriate amount as compensation.
the lawi is that a person who has obtained a decree of towards has to wait for 90 days time so that the decree becomes effective. while the set the time is an opportunity for the other spouse to appeal against the same and obtain a stay. in your case the divorce decree will not be reversed.
