Can my husband refuse taking permanent custody of child?

I have filed domestic violence case against my husband and inlaws who tortured and kicked me and my 2 year old daughter out of matrimonial home. In my complaint, i had mentioned that my inlaws have threatened to harm me and my family. Inorder to harass me, my husband has now filled application requesting weekly visiting rights to meet his daughter. I can't allow him visiting rights as he can gain sympathy from court and harm me and my family, instead i have decided to give reply by offering a full time custody of daughter to him citing this reason. Can he deny taking full time custody? After himself requesting for visiting rights?

As per the limited information provided by you, I want to make it clear that till the age of 7 the child will remain in the custody of mother as per the guidelines of the act. Secondly we have to make the Court believe that it may harm the child if visiting rights is given to the father.
