Do not ignore the summons. Even if you have not received a copy of the divorce petition, you should appear before the Family Court on the next date or engage an advocate immediately. You are entitled to obtain a copy of the petition and file your Written Statement opposing the divorce. If you do not want a divorce, you may contest the case and place your version of facts before the court. Family Courts generally attempt reconciliation and counselling before proceeding further. Since your two children are presently with your husband, you may also seek appropriate visitation rights, custody or interim access orders, depending on the circumstances. Please collect the case number and court details from the summons and obtain certified copies of the pleadings at the earliest. Failure to appear may result in ex parte proceedings against you.

Do not ignore the Alwar Court summons. Immediately obtain a copy of the divorce petition and engage an advocate. File a written statement opposing the divorce and request mediation/reconciliation. Since you are residing in Kalyan, Mumbai, you may also consider filing a Transfer Petition before the Supreme Court to transfer the case to Mumbai. Additionally, seek visitation/custody rights regarding the children if required.

We can get the petition rejected on the basis of jurisdiction if the case comes out. There is a clear provision that the divorce shall be filed where the wife has last resides at the time of filing of the divorce or where both the couple's have last resided together.

You should appear before the Alwar Court or engage a local advocate immediately. Obtain a copy of the divorce petition, file your written statement, and contest the case if you oppose divorce. You may also seek transfer to a Mumbai court and apply for child custody/visitation if required.
