Can I take child to abroad during my study period

05-Sep-2024 (In Divorce Law)
I am planning to do post doctoral fellowship at abroad, but my spouse and myself are separated for more than 3 years without filling a divorce. I have a girl child with age of 7 years. Now I would like to take her with me during the course of my studying at abroad. Will I have to ask his permission to get her .or how to handle it

hi Felix here, I can well understand your concern from the query raised, it is advisable for you to get the custody of the court before travelling abroad or get the prior permission of the husband in written form as in countries like America the act would be deemed as a child abduction if done without the prior consent of the father, anyways with regards to the visa process of your child you would need the consent of the spouse, thank you, you can contact me for further clarifications

yes you have to take the permission of the father of the child he should give consent for the child to go abroad since the law is only you and your husband is separated but the child has equal rights on both of you, di it's mandatory to get consent fro. the father of the child if you are taking the child with you to abroad
