Can I go for litigation if my husband files a divorce case after 1 yr

08-Sep-2023 (In Divorce Law)
I am living separately from my husband after 3 months of our marriage and has not filed any complaint against my in-laws even they have filed complaint in Women Cell. Due to financial situation of family and my medical condition my family is avoiding to go for litigation at-least for some time till I get medically fit and my family have funds to bear the cost of litigation charges. Is there any issues if we plan litigation after an year or we defend ourselves in court of law if forced by my in-laws, please suggest

Hi In case there are cross cases filed and there is an unwarranted delay. The court might see it as a cross action complaint / case. It is suggested that the timelines of the cases are such that would support your claims and statements. Regards

Hi, Going by the limited information provided by you, it is essential to send them a legal notice asking them for mutual separation if you want, whereby a settlement agreement will be made and both the parties agree to that terms of agreement. A mutual divorce can be granted easily and will not make a whole in pocket. We can discuss it over a call for a sane legal advise.
