Can I get share in anscestor property but divided
18-Jan-2025 (In Divorce Law)
My mother in law had 1 property got from her father and father in law got 1 property from his father after Divided his share. I filed sec9 my husband filed sec13 1ia. No kids. Cross examination going. Now I will get share in their property if they died suddenly. Or in which scenario I will get the share in property.
Dear Madam,
Please be informed that wife is not entitled for any share in either properties of husband or parents-in-law. Her right is limited to claim monthly maintenance or lumpsum amount that is alimony. But you have filed application under Section 9 of Restitution of Conjugal Rights and not for divorce. You may withdraw your case and claim alimony or monthly maintenance in case of divorce is granted in favour of your husband saying that he is inheriting the properties of his parents. Thus, you may get huge alimony.
