Can I file maintenance case on my husband now. I filed sec9 at first.

My husband left me a year ago. First I filed section 9 on him. In petition document I mentioned he was inactive in matrimonial life and dowry harassment. He filed section 13 1ia on me. In mediation center my husband claim I am cheater and liar. counsellor said mediation got failed on Sec9 case. Current Status: AWAIT REPORTS. Next hearing is on November. When can I file MC case? now or after judgement time?

you can file maintenance case at any time as it is a seperate proceeding.

maintenance under section 125 crpc makes it a criminal offense if the amount is not paid by husband to wife.

You can file your maintenance case anytime under section 125 to claim your monthly maintenance for yourself. You can also go for filing of a complaint under section 12 DV Act and claim your residential rights. And if there's no scope of living together then it's advisable to go for mutual divorce. You can file a maintenance case anytime it's your right. You can also ask for maintenance in the sec 9 case through the sec 24 HMA application. Talk to your lawyer and proceed accordingly.
