Can I file impotent case on my husband now. I filed sec9 at first.

My husband left me a year ago. First I filed section 9 on him. In petition document I mentioned he was inactive in matrimonial life and dowry harassment. He filed section 13 1ia on me. In mediation center my husband claim I am cheater and liar. counsellor said mediation got failed on Sec9 case. Now can I file impotent case on my husband?

along with your section 9 case you can file Dv case and 498A case and mention the fact that your husband is impotant and claim maintenance in Divorce case the maintenance will be decided first than case will proceed further.

You can file your maintenance case anytime under section 125 to claim your monthly maintenance for yourself. You can also go for filing of a complaint under section 12 DV Act and claim your residential rights. And if there's no scope of living together then it's advisable to go for mutual divorce.
