Can i ask for alimony after signing for mutual divorce

17-Sep-2023 (In Divorce Law)
Dear sirs. Me and my husband agreed about mutual divorce. We live in different countries. He sent me a marriage dissolution deed where it says that we settled all our disputes about alimony and child support (baby is 1,5 year old) and that husband is responsible for day to day expenses of baby till his maturity. Please guide me is it have to be some attachment about concrete amount of financial help from husband? If I will sign this document without concrete sums does it mean it won't be an official alimony and child support and he don't have to pay anything ? I am European but religion Hindu after our marriage. Is it possible at all to claim alimony without my presence in India? Thank you.

A marriage between parties one of whom at least is a citizen of India may be solemnized under the Foreign Marriage Act 1969 , by or before a marriage officer in a foreign country . You have not mentioned as to whether your marriage was solemnized under the Foreign Marriage Act 1969, or under the relevant law of the country you have been living . However in India, Such cases of mutual consent get over in a few months. The couple, with their lawyers, can sit across the table and decide on alimony and child support. An agreement is drawn and presented in a court. Once both parties agree upon the terms and conditions in front of a judge, they are granted a divorce. Please give full account of your case in my email so as to understand your case properly and advise you accordingly.

Hi, In case of divorce by mutual consent, you need to be present in court for recording your statements. The terms and conditions are pre-decided and reflected in petition. You may decide the amount of money which you need for your child. but, From your query it is not possible to know the complete facts of the case and in this situation it is difficult to clarify and advise you correctly. You are suggested to provide the complete facts.
Thanks and regards
