12-Aug-2025 (In Divorce Law)
I got married in Dec 2022, and we live as a joint family with my mother, Sister and my wife in Pune. During our wedding , my in-laws gifted me a new mobile phone worth 55,000 , a gold chain worth 50k and a microwave oven. We didnt demand these things at all. Even my wife recieved gifts from my family. But these exchange of gits were done without any pressure. Do these wedding gifts will be considered as dowry?

In a general sense, no this gifts will not be considered as dowry. However, case can still be filed by your wife or in laws. In such a case burden of proof will be on you to prove that it’s not dowry.

Hi. It depends on the facts and other circumstances. To answer specifically, without knowing other details, these gifts will not be necessarily considered as dowry, as you have said that even your wife had received gifts from your side, so you can say that the gifts received were out of love and affection and were voluntarily given. This is a very short solution, based solely on your query.

You should have made a gift list at the time of marriage as required under Rule 2 of the Dowry Prohibition (Maintenance of Lists of Presents) Rules, 1985 read with Section 3(2) of the Dowry Prohibition Act, 1961. If it’s too late, absence of the list doesn’t automatically make gifts dowry, but it weakens your defence. Keep other proof like photos, videos, and witnesses to show no demand was made. Suggestion: Prepare a post-event gift declaration, signed by both families, listing each gift, its value, giver’s name, and stating they were given voluntarily without demand, and keep it safely.

Based on what you said you didn't demanded any gift such as mobile phone gold chain microwave your in-laws give them voluntarily similarly your wife receive gift from your family. There was no pressure. You live in a joint family to. Therefore in legal terms, this is not considered dowry as long as no demand or condition was attached to these gifts. They were given out of love or custom. A list of such gifts was prepared or could be prepared, if needed. Conclusion… Exclamation they give you receive from your in-laws mobile gold chain microwave would not be considered dowry under Indian law provided they were given voluntarily, without demand, an idly are documented.

Voluntary gifts from friends, relatives, or well-wishers without expectation from the bride or groom are not dowry. Gifts given by the bride’s or groom’s family to influence the marriage or to the spouse’s family can legally be treated as dowry if there’s expectation or compulsion.
