Can divorce case be filed from the hometown of wife

My sister married for 15yrs.in this 15yrs her husband always use abusive words. For food, cloths everything he is pointing to bring from fathers house. They have 12yrs daughter.. Now she want to get divorce as he is not leaving any chance to abuse her by worst slangs and words. She is staying in nagpur now. So if we will take her back to our hometown. Is that fine to raise complaint in my hometown police station and then proceeding with divorce case?

It seems your sister and sister's 12 year old daughter are subjected to extreme form of violence.
You must ensure the following at the earliest,
1. Keep your sister and her minor daughter at a safe place.
2. Register a police complaint at the nearest police station. You can register it at the hometown of your sister.
3. Seek help of a good lawyer and file Domestic Violence Proceedings at an appropriate Court.

Hello, advising you with the incomplete details, for good advise the full details are required. You have not mentioned the religion , if your sister is hindu then yes she can file petition for divorce from Nagpur. Ty

It is complete freedom of your sister's comfort and access to file a suit where ever she wants to stay back and if it's her daughter's schooling n other resposibilites at stalk then it becomes a preference n choice of your sister's will and wish too

The jurisdiction of family court is the spouse whether lastly resides and where the marriage was solemnizes. except that jurisdiction u have no right to approach any other place. Then then victim itselfe can approach to family court for divorce.

If she does not have any source of income she may file a petition in her native place and also her court fees will be waived off.

She can also apply for interim maintenance and legal expenses along with the petition.

Also she can file application to recover her stridhan along with the petition.
