Can advocate appear before the family court without vakalatnama

23-Oct-2023 (In Divorce Law)
My husband has filed case for divorce in Bangalore. I have appointed advocate and have prepared vakalatanama. But the vakalatanama affidavit is not there(couldn't prepare because time was not there) and I am abroad for studies now. I cannot come for the first appearance. Will the family court accept him as my advocate without the affidavit ? What should I do ? Please help !!

If your not able to come on the first appearance an advocate can appear on your behalf and file memo for your appearance and pray time to file vakalath ... Hence in thus way the court will give certain time for your appearance and you can attend in the next date of hearing

No madam, there is a specif rule in the family court that each vakalath nama should carry an authorization to represent the case and the said authorization should be in the format of application along with the supporting affidavit.
