Can a wife appeal in high court after mutual agreement for divorce

Hello, I got divorced last year and I have got the divorce papers too last year. With mutual agreement, I paid one time settlement of 5 lakh that time and the case was closed in the family court. My wife is already working and still I had to take loan etc and pay money in their account as they were not ready to sign to papers and decided to torture my life. Anyways now after one year of divorce, they have filled a case in higher court asking for monthly maintenance. Post divorce I assume we are no way related to each other and they cant file case again and torture my life. Please advise.

Paying one time settlement shall not absolve of maintenance.

















































































The amount should be substantially higher to maintain herself.

Since you got divorce decree last year, appeal priod is over, so appeal not maintainable. You paid rs 5 lakhs as alimony in permanent settlement, but she might have moved high court for enhancement of alimony. If the one time settlement of alimony agreed by both of you, her petition shall not maintainable, but if she was not agreed for the alimony granted, she can file appeal in alimony petition. File your counter stating about money paid, reason to fix the paid amount, your income and disability to pay more than what paid. It will consider by high court.

Hello sir after closing case by mutual divorce they cannot file claim in any provisions of laws but before that you get clarify about on what terms and conditions mutual divorce happened between u an your wife.
