Can A Muslim Husband File A Divorce Petition

My wife has deserted me since 2016 and filed 498a, 377, 66 of it act, DV case and CRPC case against me.As per court order I am paying her maintenance of 20K. In chargesheet police has removed the sec 377 and 66 of it act. Now on this ground can I file a divorce petition. Will judge increase her maintenance or ask me to provide alternate accommodation for her.

Well, if Police has removed certain sections from your Chargesheet, it doesn't mean, that, such sections can't be imposed upon you again, Court will see whether Police had filed proper chargesheet or not before it.
