Can a marriage be nullified if the boy has lied about certain facts

I got married 7 months before. He written on bio data that he is a bcom graduate and they showed their property two shops l. After marriage I found him really weird as he behaves thinks and talks like a pure illeterate person. He doesn't even knwo small english words. I cross verified many things and then I came to know he is 10th fail. He achieved a degree from some village from where anyone can get a degree even if u didn't clear ur 10th or 12th but he never revealed it to me I asked him mamy times about his marks but he always use to ignore. m a CA INTER pass and now pursuing my ca final. The day when I came i.e 2 months after marriage know about his fake education I left that house and never returned back we both took divorce in front of our samaj on stamp paper but I know that is mot valid but he is so illeterate that he doesn't even know that's it's not legally valid. now I want to know can I appeat for nullify of marriage based on fraud reason

Well yes, you can go for nullity of marriage but one thing goes against you. As per the query you have stated that you two have already taken a divorce on stamp paper from your samaj; however such divorce has no stand legally, but indirectly you have waived the fraud committed to you by indulging in a divorce instead of a stand of nullity. So in my opinion I think that you need to decide first whether you want to challenge the marriage on the ground of fraud or to seek a divorce from court by waiving you right to nullity and that you cannot file both the cases simultaneously.

No marriage can't be nullified only on this ground.
But if you think you have been cheated by him then on this ground you can take divorce from him.
If you stay away from him till one year then u can get MCD.

Definitely u can nullify ur marriage by filing case but I will advice u to go for divorce by mutual concent. From ur information I think he is ready to give divorce then in such situations besy option is to obtain divorce by mutual consent.

Yes you can get divorce on the basis of misrepresentation and fraud about the degree and husband being a criminal intellect may go to jail for such fake and illegal documents. He may have done some other frauds may be but this very fraud could lead to a jail term so all that is accountable for divorce and you can ask for maintenance and compensation.
