Can a Contested divorce be converted into a mutual
23-Jun-2023 (In Divorce Law)
Hi, I am the husband who filed a contested divorce and there was a hearing where my wife asked for a court appointed lawyer and we have been given the next date for mediation with both side lawyer present. Now my wife has agreed to do this mutually. My lawyer is telling that a new petition has to be filed and again asking full money of 50k. I had already paid 50k for contested. My question is on our next date can't my wife tell that she is ready for mutual and this case can be converted to mutual without starting a fresh petition which will again take more time to get a date for.
In your matter since it’s already posted for mediation, please tell the counselor that both of you are agreeable for divorce. Please mention your terms and conditions
The counselor will file a report to the court and consequently the court will rule .
You don’t have to file a separate petition
