Hi there, in short yes he can request court for initiating perjury proceedings against you. However, based on the details of the statements of cross examination you can explain the transactions to the court. You have to sit with your lawyer and prepare a proper strategy. In this case, you can defend the perjury allegation by establishing that the UPI transactions were unrelated to any alleged adulterous relationship and had no bearing on the divorce proceedings. The denial during cross-examination was not deliberate or material but made under a bona fide misunderstanding. As per settled law, perjury is made out only when a false statement is given wilfully and materially to mislead the court. Since the transactions were of casual or friendly nature and not connected with the case merits, it does not constitute wilful false evidence under Section 191 IPC, and prosecution under Section 340 CrPC would not be justified.
