Arrest warrant through JCP - NDOH

31-May-2026 (In Divorce Law)
Judge has issued warrant of arrest through joint commissioner of police against JD (Execution application). How does this work after filling PF in the court, what is the difference between warrant through SHO, ACP. DCP and JCP , where will the warrant be sent for processing (nearest police station or JCP office in Delhi) , do they arrest the JD / accused immediately or before NDOH ? Is this warrant bailable because conduct of accused has not been good ( absence and excuses without proofs)

If warrant of arrest is issued then police has the power to arrest the accused and only court can grant bail subject to conditions so under these circumstances appropriate measures should be taken to protect from the arrest

If the arrest warrant is issued through the JCP, it is generally routed through the concerned district police and local SHO for execution. Whether the JD is arrested immediately depends on police execution and availability. Bailability depends on the nature of the warrant and the court's order. Repeated absence may weigh against the JD, but only the court can decide further action. Please consult the case records for the exact warrant terms.

After filing PF in execution, the court may direct police to execute the arrest warrant. Authority level (SHO/ACP/DCP/JCP) affects supervision, not validity. Police act as per warrant and court directions; arrest may occur before the next date. Bailability depends on facts and law.

So warrants can be issued through different ranks of police officials. A more senior rank means more chances of securing the attendance of the JD. It will be sent to the concerned police station. Generally the warrants are executed closer to the date of hearing but there is no rule that it cannot be executed before in time. Speaking for the accused he will have to get the warrants cancelled before they are executed and he is arrested.
