Any legal punishment for cheating wife who is ready to divorce ?

This is 2nd mrg to both of us.we both r employees. I got the evidence of wife chat with his bf to defame me and escaping plan.I took this matter to our elders and then she apologized to not repeat it.bt fr 2nd time also she got caught by me and now she lodged a complaint on her bf upon my request.after 1 month of this her behaviour got changed and now she went to her parental home without informing me. I want 2 save dis mrg.what legal action/punishment can I take if she ties to divorce me?

You may first issue a formal notice urging your wife to resume cohabitation and fulfil her marital duties under Section 9 of the Hindu Marriage Act (Restitution of Conjugal Rights). Her repeated acts of infidelity, false allegations, and mental cruelty give you strong legal grounds to defend any divorce petition she files and, if needed, to file for divorce yourself on the ground of cruelty and adultery. You may also file a private complaint or criminal case against her and the alleged partner under Sections 494/497 (Bharatiya Nyaya Sanhita 2023 – Adultery) if sufficient proof exists. Preserve all chats, apologies, and complaint copies as evidence. Consult a High Court Advocate for drafting and filing proceedings at the earliest to protect your rights and reputation.

you have every right to divorce her keep all the evidence handy with you even if she files a case you can produce your evidences and even the elders who had your panchayat is evidence for you. but collect maximum evidences handy with you so that you can produce them in front of the officer concern readily.
