26-Oct-2023 (In Divorce Law)
Living separately from wife for last 2 years. I m working in a private firm drawing 1 lakh per month, my wife is working in bank of maharashtra drawing salary of 35k- 40k (approximately). Both my parents are diabetic and suffering from hypertension. I am also diabetic. My 3 years old daughter lives with my wife. Its been 6 years to my marriage and for last 2 years we are living separately without any communication. Wife living at her parents home. She was dominating and ill treated me. What could be the monthly maintainance or permanent alimony? Considering all these scenario.

Well, How much will be the Maintenance depends upon your Income and Expenses + What Moveable and Immovable assets you have. You have to furnish such on affidavit in Court, based on which, Maintenance and Alimony will be decided.

Usually, the husband is bound to maintain his wife till her lifetime but desertion sans reason and willful refusal of woman to stay with the husband would mean that the wife shall not get any maintenance. However, both desertion or willful refusal to live with the husband need to be proved.

usually it is 1/3 of the salary but the other responsibilities of dependents will be considered if they are not earning or any other sufficient income to survive. because you have a girl child the court may fix maintenance till her majority or marriage
