To request a reduction or cancellation of maintenance or alimony in India, you must file an Application for Alteration/Modification of Maintenance under the specific law under which the original order was passed. The child custody case can be filed. The most crucial factor in how alimony is calculated in India is the financial status of both spouses. Courts meticulously examine the income, assets, investments, and liabilities of both parties. The earning spouse's monthly salary, business income, rental income, and other sources of revenue are thoroughly assessed. Indian courts have established a general benchmark where maintenance typically ranges between 20% to 30% of the husband's net monthly income for periodic payments. The Supreme Court has set 25% of the husband's net salary as a reasonable amount for monthly alimony. However, for lump-sum settlements, the amount can range from one-fifth to one-third of the spouse's net worth.

Demanding ₹20 lakh alimony does not automatically make it payable. The court will consider your income, liabilities, child’s needs and both parties’ financial status. If there is no false case or unlawful act, no separate harassment case lies merely for demanding higher alimony. You may contest the claim and place proof of your income and maintenance payments before the court.
