18-Aug-2023 (In Divorce Law)
Hi Team, I had contested for divorce since my wife deserted me 4 years back. Now they have come for settlement and terms and conditions have been mentioned and agreed. But they are not agreeing for execution terms. So does this mean if execution terms are not mentioned then the other terms and conditions can be violated.? Pls clarify

If you have decided to go for mutual divorce then it's advisable to draft a settlement deed first and write down all the terms and conditions in it. And the other terms and conditions will not be violative in nature unless and until you write it in a way that the execution terms don't affect other terms. You should take a second opinion but for that you need to get the settlement terms and conditions legally vetted from a lawyer having expertise in matrimonial laws. Terms and conditions and their execution terms should go hand in hand and should be specifically incorporated in the MOU without any ambiguity. For further advise you may connect

settlement terms must be agreeable to both parties contesting the divorce. I really you should not have any clause which is against you in the settlement agreement. if you apprehend that your wife might in infringe the agreed settlement terms you can insert a clause which would allow you to resume divorce proceedings in case the wife breaks any terms or conditions of the settlement
