After filing for mutual divorce wife not allowing to meet kids

22-Mar-2023 (In Divorce Law)

Me and my wife filed a mutual divorce on Feb 2016. Our hearing in august 2016, During the agreement my wife agreed to allow me and my mother to talk to my kids. and I had volunterily agreed to pay 5000 each for my two kids. but now she is not allowing me to see or talk to them. she has shifted her house. I was thrown out of my own house. and I am paying 10000 for Feb & march already. my question is do I have to pay monthly before the decree is issued? Or can start after court grants me divorce.

Ans: You can enforce the conditions imposed by the court and complain in the court for non compliance of the visiting rights. further untill she allows seek for abeyance of the maintenance

you can very well make application before the same court that your wife has violated the terms and conditions of the mutual agreement. your question is not clear whether your are paying monthly rent for the new house or for the kids. if you have agreed in the agreement to give monthly maintenance to your kids then you have to pay. as it start from the date of signing the agreement

No maintenance is to be paid even during the pendency of the trail also, u can advance the case and can file an application seeking for visiting rights and fix a timing in which you can meet your children
