the matter you had told is a well fit for parallel case against harrasment and mental agony created to your child by husband family and this can be filed under DV act against the husband family for proper justice to your child.

The question is whether she wants to live with him or not. If she don't want to live with him you could file for Mutual divorce. She may file petition for return of gold and money if any. If I know the actual facts I could help you more. For more details you may contact me.

your remady available under DV act. you have to file petition under domestic violence. with regard to divorce ptn, if you are not willing for divorce you have to file counter and contest case before family court. mean while you can file original petition for recovering your gold and cash. and another maintenance petition can also file for getting maintenance

Yes, this situation is legally significant. If the husband has filed for divorce after subjecting the wife to abuse, the wife has strong legal remedies available. Such abuse amounts to cruelty, and the wife can contest the divorce and also initiate independent proceedings under the Protection of Women from Domestic Violence Act, 2005 seeking protection, residence, and compensation. She can also claim maintenance and litigation expenses. Depending on the nature of the abuse, criminal action under Section 498A IPC can also be considered. Before taking further steps, it is important to examine the facts and documents in detail to decide the appropriate legal strategy. You may share more details so I can guide you on the next course of action.
