Actually I filed police complaint against my husband and in-laws by IPC 323,504,506.and now I am living with parents. How can I go at my matrimonial home without dv case? I don't want to complicate the things. But I want residential right and protection. Without dv case can be possible to get my all rights?

Residential right and protection can only be granted after order of the court. and for that to happen, you have to file a domestic violence case. You have the right to live in your matrimonial home, but you cannot get a residential right and protection order without going to court

Well, without filing a DV Case, if you want to live in your Husband's Home along with him and In Laws, then you have to compromise with them and you have to withdraw all the cases filed by you against them to live with them happily ever after and if you do not want to do that, then, there lies no option other than filing a DV Case to secure your Right of Share Household, Right of Maintenance and Protection Orders.

Dear Queriest Domestic Violence gives you right of residential rights and protection if you already know that if DV is filed under those particular sections you wil definitely get this protection then why to complicate by not filing it also if it was so simple then you would have had a meeting with your in laws and your husband and have said them I want to come back and stay in my matrimonial home, actually you are still legally wedded wife therefore you can directly to and stay at your matrimonial house.
