498a case chargesheet based on FIR or completely different
08-Jun-2026 (In Divorce Law)
They filed FIR very vague way in 498a by my wife now how the police will file a chargesheet! Will they alter the things which mentioned in FIR while filing the chargesheet? Court trial will run on chargesheet based or FIR based?
An FIR is only the starting point of the criminal process. The police are required to conduct an independent investigation and thereafter file a charge sheet based on the evidence collected during investigation. While the police may elaborate, clarify, or add supporting material gathered during investigation, they cannot arbitrarily improve a weak case or substitute evidence where none exists.
The trial is primarily conducted on the basis of the charges framed by the Court and the evidence produced during trial. The FIR, charge sheet, witness statements, documents, and oral evidence are all relevant; however, conviction cannot be based merely on allegations contained in the FIR. If the FIR contains vague, omnibus, or generalized allegations without specific instances, dates, acts, or supporting evidence, such deficiencies can be effectively highlighted during discharge proceedings, cross-examination, and final arguments. Ultimately, the prosecution must prove its case beyond reasonable doubt, and vague allegations alone are insufficient to sustain a conviction.
